TERMS OF ENGAGEMENT
TERMS OF ENGAGEMENT BETWEEN NORTHLAND ROOF COATINGS & CUSTOMER.
1.1 All work carried out by Northland Roof Coatings Ltd is undertaken on the terms and conditions set out herein and on no other terms and conditions unless agreed between both parties in writing.
1.2 We have priced to use The Pro coat Coating System, unless otherwise specified. There may be additional costs to use an alternative brand.
2.1 Upon acceptance of the quote a deposit of 30% of total cost is to be paid prior to the commencement of works. Full payment is due within three days from the issue date of invoice unless otherwise previously arranged.
2.2 If full payment of Invoice is not made by the invoice due date, Northland Roof Coatings Ltd reserves the right to charge interest at 6% per month on the total invoice amount outstanding, from date payment was due up until such time that payment is made in full.
2.3 Roof and Exterior works may be invoiced separately or together. On most occasions, the roof painting will be completed first, Therefore, on completion of the roof painting, the invoice will be sent.
2.4 Progress Payments – All work exceeding $10,000 will be subject to progress payments.
3.1 Northland Roof Coatings Ltd guarantees to supply only high-quality materials for their resurfacing systems and, subject to the special provisions set out herein, guarantees to protect the customer from any loss of adhesion from the substrate through flaking, peeling, or chipping for a period of 10 years from the date of application; providing an annual moss treatment has been applied to the roof surface. Northland Roof Coatings Ltd reserve the rights to ask for proof of maintenance.
3.2 Northland Roof Coatings Ltd shall replace or repair faulty materials where it is satisfied that the fault has not been caused by factors beyond its control. Such factors include surface movement, loss of adhesion adjacent to cracks, movement of expansion joints, base movement, defective building structures, hydrostatic pressure, mechanical or physical damage or any latent defects, and deficiencies in the surface to which it is applied. This also includes any lack of adhesion to the nose (tile ends) after five years.
4.1 A maintenance moss control application is recommended yearly (in accordance with coating manufacturer’s recommendations). The costs of this maintenance are the responsibility of the Customer. The average cost of moss treatments ranges from approximately $350 - $500 +GST.
4.2 Should the Customer conform to the recommendations (section 4.1), Northland Roof Coatings Ltd:
5.1 Northland Roof Coatings Ltd warrants the workmanship of repairs and
coatings of surfaces in accordance with manufacturer’s specifications and guarantees the works against defective workmanship for a period of 2 years. However, if a breakdown was to occur, it would be visible within the first three months from date of application. This warranty excludes leaks.
6.1 All claims relative to warranty shall be notified to Northland Roof Coatings Ltd (as the case may require) within three months of the first sign of failure of materials or application.
6.2 No claim shall be accepted unless the customer has made full payment for the works carried out.
6.3 On no account shall the liability of Northland Roof Coatings Ltd exceed the value of the materials and services supplied.
6.4 On no account shall the liability of Northland Roof Coatings Ltd exceed the contract price paid to Northland Roof Coatings Ltd by the customer.
6.5 Although we use the best treatments available, we cannot guarantee against rust. There is no warranty if rust breaks through after rust treatment is applied (unfortunately no supplier will guarantee this).
6.6 This warranty will only apply if the customer has adhered to obligations as per terms and conditions details in Section 4 of this document.
6.7 The quote relates to the main roof of the house and excludes all verandas, porches, sheds, garages, carports, flat roof, bay windows, awning, chimney, gutters, downpipes, or any other area unless specifically stated.
6.8 In coating the bottom tiles at the gutter line, it is unavoidable to not get paint inside the gutters. Hand masking is available upon request at an extra cost. It is usually impossible to coat the very bottom toe edge of the gutter line tiles, due to the closeness of the gutter they are not seen from the ground.
6.9 Solar panels/pipes will be painted around. We do not paint in between or underneath unless removed. Removal is the Customers responsibility prior to commencement of works.
6.10 Gutter mesh is to be removed prior to Northland Roof Coatings Ltd commencing work. Northland Roof Coatings Ltd can remove this at an extra cost but will not be responsible for re-installation.
6.11 All pipes’ protrusions from the roof will be coated unless Customer has advised not to prior to the painting stage.
7.1 Leaking Roofs
In conjunction with locating any leaks your roof has, Northland Roof Coatings Ltd requires you, the customer, to inform us of any problems your roof has that you are aware of. Northland Roof Coatings Ltd will repair the problem, and in instances where this is not possible, you will be advised accordingly, (e.g. replacing a valley may require a plumber). If the customer is aware of roof leaks and Northland Roof Coatings were not informed prior to the start of works, we cannot be held responsible for the problem.
Northland Roof Coatings Ltd guarantees its workmanship in applying the surface coating. Once the roof has been done, Northland Roof Coatings Ltd will return to inspect. If leaks occur, Northland Roof Coatings will make the necessary repairs within reasonable expectation. If leaks are caused by reasons outside of our control, Northland Roof Coatings Ltd will advise the Customer as to what can be done. We cannot guarantee a roof against leaks, so leaks that occur after a reasonable time from completion (approx. three months) may involve a charge to locate leak and carry out repairs. In the unlikely event of damage caused due to water blasting, Northland Roof Coatings Ltd reserve the right to fix/clean areas or surfaces.
7.2 Old tiled roofs
Please note we apply significant water cleaning pressure in the preparation of your roof to remove organic growth, dirt, and previous coatings. Some masonry tiles can be porous, and this may mean some water may enter the roof space. We recommend that you move or cover any items in the roof space to prevent damage in the unlikely event of this occurring. Northland Roof Coatings cannot prevent this from occurring as porosity is unknown until the tile is sufficiently clean. It is key to the success of the recoating process that the tile is clean to provide a suitable base for coating. We will not be held responsible for any damage this potential porosity may cause.
7.3 Roofs previously coated / painted.
We take responsibility for carrying out a proper inspection of your roof. However, should work on your roof subsequently reveal structural or latent problems that were not apparent at the initial inspection, we reserve the right to renegotiate a remedy to repair if possible or, in extreme cases, may need to terminate the contract.
Upon water blasting, some roofs become what we term a ‘Flaky Roof’. The cause of this is in the previous application being wrongly applied. In case of a “flaky roof,” works will come to a stop until the customer is made aware of the potential mess that may be caused by flaking. We will clean to the best of our best ability, but in most cases, not all paint flakes can be removed from gardens, stone/pebble walkways, and grassed areas so we will ask you to consider this before continuing.
In some cases, oxide from the roof may temporarily leave streaks on the windows. We will soft wash to the best of our ability but will not be held responsible for professionally cleaning the windows.
7.4 Weather Constraints
All works are carried out subject to weather permitting. The preparation for, and the application of the Procoat Coating System is naturally very weather dependent. Rain, wind, and excessive heat can disrupt the roof restoration process. We try to use the most favourable weather conditions (dry & calm) for the paint coating application process.
As a general rule, we would normally start preparation 4-5 weeks from the acceptance of a quote. We may start earlier for individual customer requirements or delay starts due to our workload.
7.5 Steep or High Roofs
Please note steep roofs can sometimes look a little patchy, especially using dark colours. We highly recommend using lighter colours to minimize patchiness. This usually improves over time as the roof weathers.
7.6 Safety
Northland Roof Coatings Ltd is committed to maintaining safe and healthy workplace practices. All equipment is maintained regularly to ensure it is safe to operate. Relevant standards and guidelines will be followed in accordance with the Health and Safety at work Act 2015.
7.7 Damage
If there is any damage to the inside of the building/dwelling caused from work related activity such as banging or painting on top of the roof, Northland Roof Coatings cannot be held responsible. At the water blasting stage, the spouting is flushed from debris. In some cases, the spouting may be rusty or brittle if you have PVC gutters, which cannot be seen upon inspecting the roof. If the rusted areas are exposed during the flush, we cannot be held responsible for this.
7.8 Broken tiles
Northland Roof Coatings Ltd price based on replacing badly broken tiles. We do not replace all chipped tiles unless this is specifically requested before commencement of works. Extra charges will apply to replace chipped tiles.
7.9 Cleaning of gutters
As part of the preparation process the roof surface must first be cleaned. This is carried out with a high-pressure water blaster. Debris, sand, leaves, and other material can get caught in the gutter, as part of this service we FLUSH the INSIDE of gutters and RINSE off the OUTSIDE. Some debris may remain in the gutters. We DO NOT clean the outside of gutters from original dirt.
Northland Roof Coatings Ltd outsource the edge protection installation and dismantle. Northland Roof Coatings Ltd accept no responsibility to damage caused by Edge protection installers. Any damages caused by installers shall be settled between customer and installers.
